These Terms & Conditions apply to goods supplied by Falcon Draping Ltd, London Road, Henfield, BN5 9AA (“Falcon Draping”, “we”, “us” or “our”).
By placing an order with us, you agree to these Terms & Conditions.
An order becomes binding once it has been accepted by us.
Customers are responsible for checking product specifications, measurements, quantities, colours, delivery details and other requirements before confirming an order.
We reserve the right to refuse or cancel an order where a product is unavailable, a pricing or description error has occurred, or we reasonably cannot fulfil the order. Any payment already made for goods we cannot supply will be refunded.
We make reasonable efforts to ensure product photographs, descriptions, dimensions and specifications are accurate.
Fabric colours, textures and finishes may appear differently depending on lighting, screens and production batches. Minor variations between samples, photographs and supplied material are not necessarily defects.
Where colour matching is particularly important, customers should request a physical sample before ordering where available.
Unless stated otherwise, prices are shown exclusive of VAT, which will be added at the applicable rate.
Delivery and other applicable charges will be shown separately or confirmed as part of the quotation or order.
We may change our prices at any time, but changes will not normally affect orders already accepted by us.
Payment must be made according to the terms stated on the order, quotation, invoice or trade account.
We may require full payment before manufacture or dispatch.
Goods remain the property of Falcon Draping Ltd until we have received payment in full.
Many Falcon Draping products are manufactured, cut, altered or otherwise prepared specifically for an individual customer.
Customers must carefully check dimensions, quantities, colours, fabrics and specifications before approving bespoke work.
Once manufacture, cutting or alteration has begun, made-to-order, personalised, cut-to-length or bespoke products cannot normally be cancelled or returned because the customer has changed their mind.
This does not affect rights relating to products which are faulty, damaged or not as described.
Consumer customers may have statutory cancellation and return rights for qualifying standard products purchased at a distance.
Those rights do not generally apply in the same way to goods manufactured or customised to the customer’s specification.
For business and trade customers, returns of correctly supplied standard goods are at our discretion unless otherwise agreed in writing.
Where we agree to accept a discretionary return, products must normally be unused, undamaged and in their original condition and packaging. Reasonable delivery, collection or restocking costs may be deducted where permitted.
Nothing in these terms removes any statutory rights which cannot legally be excluded.
Delivery and dispatch dates are estimates unless we specifically agree otherwise in writing.
We will make reasonable efforts to meet estimated dates but cannot guarantee delivery times where delays arise from circumstances outside our reasonable control, including carrier delays, supplier delays, transport disruption, severe weather or other events beyond our control.
Customers are responsible for supplying a complete and accurate delivery address and any relevant delivery instructions.
Where tracking records an order as delivered, customers should first check the delivery location, reception areas, nominated safe places and with other people reasonably likely to have accepted the delivery.
Where a delivery is disputed, we may obtain and consider evidence from the carrier, including tracking records, GPS information, photographs, delivery scans and signatures.
Customers must provide reasonable information requested by us so that we can investigate a missing-delivery claim with the carrier.
Delivery to the customer, a person nominated by the customer, or an authorised safe place or alternative delivery location may constitute completed delivery.
A signature, photograph, tracking record or other proof of delivery may be used as evidence that delivery took place. However, these provisions do not affect statutory consumer rights, including where goods have not actually been delivered to the customer or a person authorised by them.
We reserve the right to investigate disputed delivery claims before issuing a replacement or refund.
Customers should inspect deliveries as soon as reasonably possible after receipt.

Where goods are faulty, damaged in transit, incorrectly supplied or not as described, we will provide the appropriate repair, replacement, refund or other remedy in accordance with applicable law.
Customers are responsible for ensuring products are suitable for their intended purpose and that measurements and specifications supplied to us are accurate.
Falcon Draping has practical event-industry experience and is happy to provide guidance on selecting pipe and drape systems, curtains and associated equipment.
However, unless we have expressly agreed responsibility for a specification in writing, the customer remains responsible for the final selection and safe use of the products purchased.
Where a product is described as FR, IFR or flame retardant, this relates to the particular product, treatment or certification supplied.
Requirements can differ between venues, event organisers, insurers and authorities.
Customers are responsible for establishing whether a particular material, product or certificate satisfies the requirements applicable to their venue or intended use before placing an order.
Where certification is available, please ask us if you require documentation for a particular product.
Pipe and drape systems and associated hardware must be assembled, positioned, weighted and used appropriately for the environment in which they are installed.
Customers are responsible for competent installation and for assessing relevant site conditions, including floor conditions, height, loading, public access and other safety considerations.
Products must not be used beyond their stated or reasonably intended capabilities.
Trade accounts and credit facilities are offered entirely at our discretion.
Invoices must be paid within the agreed payment terms.
Where an account becomes overdue, we may suspend further orders, withdraw credit facilities or require payment in advance for future orders.
We reserve any statutory rights relating to late payment of commercial debts.
Nothing in these terms excludes or limits liability where doing so would be unlawful.
Subject to applicable law, Falcon Draping Ltd will not be responsible for indirect or consequential business losses resulting from the use, inability to use or delayed delivery of our products.
For business customers, we will not be responsible for loss of profit, revenue, business, contracts or anticipated savings where such liability may lawfully be excluded.
We will not be responsible for failure or delay caused by circumstances outside our reasonable control, including severe weather, transport disruption, industrial action, supplier failure, import or customs delays, natural disasters, governmental action or significant disruption to communications or infrastructure.
Unless otherwise stated, website content, product photographs, graphics, designs, written material and other content created by or for Falcon Draping Ltd remain our intellectual property.
They may not be reproduced or used commercially without our permission.
Personal information is handled in accordance with our Privacy Policy and applicable UK data-protection legislation.
We may update these Terms & Conditions from time to time. The terms applying to an order will normally be those in force when that order was placed.
These Terms & Conditions are governed by the laws of England and Wales.
Where legally permitted, disputes relating to business-to-business transactions will be subject to the jurisdiction of the courts of England and Wales.
Nothing in this provision removes any mandatory jurisdictional rights available to consumers.
